要 公有建築工程以「統包」方式辦理，將設計－興建－維護結合由統包商承攬，於政府採購法頒布相關作業辦法，有了法源依據後，成為近年來國內公部門常用的發包方式，本研究將以業主的角度，探討選擇使用「統包」發包方式前所應具備的認知，並選擇國內以統包方式辦理公有建築發包的案例中，蒐集二個分別為辦公室及集合住宅的案例，配合比對「行政院公共工程委員會」九十年十一月出版之「設計與建造契約、統包契約文件之研訂」及1999年版FIDIC之設計與建造及統包契約條款，分析需求規範應有的內容、發包方式對其訂立的影響，專案執行中需求規範變動所造成的影響，最後整理出訂立較周全之「業主辦理統包時需求規範檢查表」，提出以「統包」方式辦理時，需求規範的變更將造成計價及工期的契約爭議，故導出一旦需求規範變動時均視為新增單價變更為較佳選擇的結論。 | |||
| 摘要(英) | ABSTRACT Turnkey has been widely implemented in public building construction by some of the public sections since the related regulations have been issued in the government procurement law. Therefore, the research will investigate which understanding the owner should had before implementing turnkey as the procurement strategy. Also, the study will pick two cases which had been implemented by turnkey as the procurement strategy. According to the regulations issued by the public construction commission, the research will investigate the impact which resulted from the change of the requirement’s specification by the owner when the project was executing in the middle of the period. The research will suggest a check list of the requirement’s specification from the owner, and reach a conclusion which the change of the requirement’s specification will result in the dispute of the billing and schedule. | |||
